We make a special effort here to record the facts as we receive them. At times, there may be error but we do try to use our best judgement at the time of posting, and will be glad to amend any details which are proved incorrect. Furthermore, even though we do not here discuss the human cost, we realize that losing anyone in an air accident is insurmountable tragedy to individuals, families and communities. We do extend our heartfelt sympathy to those whose loss we record here. Pilot should not have flown




What: Home-built RV-7 single-engine four-seat plane
Where: east of the Shark River Municipal Marina, near the number three buoy near Shark River Island, in about three feet of water
When: July 5 6:53 p.m
Who: Point Pleasant Beach pilot Richard Jahns,
Why: Pilot should not have been flying on the day of the accident, according to a federal report. The National Transportation Safety Board, said that "instrument meteorological conditions prevailed" at the time of the flight, but that Jahns "did not hold an instrument rating."

Under the Code of Federal Regulations Title 14 Section 63.1(e), entitled instrument rating, "no person may act as pilot in command of a civil aircraft under (Instrument Flight Rules) or in weather conditions less than the minimums prescribed for (Visual Flight Rules) flight unless that person holds: (1) The appropriate aircraft category, class, type (if required), and instrument rating on that person's pilot certificate for any airplane, helicopter, or powered-lift being flown."
